In homeowners’ associations, approving the annual accounts is essential to maintain transparency and ensure the proper functioning of the building or residential complex. However, what happens when a neighbor decides not to approve them?

What are the community accounts?

The community accounts reflect all the income and expenses incurred by the property over a specific period, usually one fiscal year. Their purpose is to show how the shared funds have been used: from payments to maintenance suppliers, electricity, or water, to extraordinary assessments or unpaid fees from delinquent owners.

The Spanish Horizontal Property Law (LPH) establishes that these accounts must be approved by the General Assembly of Owners, which meets at least once a year. At this meeting, a balance sheet for the previous year and the budget for the following year are presented.

You can consult the full text of the LPH on the official BOE website.

Can a neighbor refuse to approve the accounts?

Yes. Any owner has the right to vote against approving the accounts. The reasons may include disagreements with certain expenses, lack of information, accounting errors, or even distrust in the management by the president or administrator.

However, for the opposition to have legal effects, it is important that:

The owner attended or was represented at the meeting.

They recorded their disagreement during the meeting.

They formally challenge the decision if they believe it violates their rights.

What happens if the accounts are not approved?

If one or even several neighbors do not approve the accounts, this does not automatically prevent their approval, as long as the majority required by the LPH is reached.

The approval of the accounts requires a simple majority of the owners present or represented, who must also represent the majority of the participation quotas. In other words, if there are 10 owners at the meeting and 6 vote in favor (holding more than 50% of the quotas), the accounts are approved, even if 4 vote against.

What if there is no majority?

In that case, the accounts are not approved, and a new meeting must be called or an alternative sought, such as reviewing and correcting the identified errors. The lack of approval can halt important decisions such as hiring services, starting construction works, or issuing payment receipts, which can seriously affect the community.

Can a neighbor challenge the accounts?

Yes. An owner can legally challenge the decision to approve the accounts if they believe there has been:

A violation of the law or the bylaws.

An abuse of rights by the majority.

A lack of information or documentation.

The challenge must be filed within three months from the notification of the meeting minutes, or within one year if the decision is contrary to the law. Furthermore, the owner must be up to date with their payments to exercise this right, unless the challenge directly concerns that debt.

You can read more about how to challenge community agreements on the website of the General Council of Property Administrators of Spain.

What if a neighbor does not attend the meeting?

If an owner does not attend the meeting but later disagrees with the accounts, they have a period of 30 days from receiving the minutes to express their opposition. If they do not do so, it is understood that they tacitly accept the decision. This is why it is so important to read the minutes carefully and respond within the legal deadline.

Practical consequences of not approving the accounts

Blocked Works or Improvements
Without approved budgets, no renovations or improvements to the building can be carried out.

Legal and Accounting Difficulties
The community cannot present clear accounts or report to tax authorities or banks.

Loss of Trust
Creates tension among neighbors and with the administrator, damaging community relations.

Increase in Delinquency
Some neighbors may use the lack of approval as an excuse not to pay fees.

Approving the community accounts is an essential element for the proper functioning of any building. If a neighbor disagrees with the accounts, they have the right to express their opinion and take action, but always within the legal framework.

At MartinProperties, as experts in property management and homeowners’ association administration, we recommend dialogue, transparency, and professional advice to resolve any conflict constructively.

If you need help managing your community or resolving conflicts between neighbors, do not hesitate to contact us.
